3. Intellectual Property

The content on our website, including but not limited to text, graphics, logos, images, designs, and software, is the property of Tharkhap and is protected by copyright and other intellectual property laws.

Design concepts, drawings, specifications, and other materials created by Tharkhap for client projects remain the intellectual property of Tharkhap unless otherwise specified in a written agreement.

You may not reproduce, distribute, modify, display, or use any content from our website without our prior written permission.

4. Client Responsibilities

When engaging our services, clients are responsible for:

  • Providing accurate information about their needs, preferences, and spaces
  • Reviewing and approving design concepts and specifications in a timely manner
  • Providing timely access to spaces as needed for measurements, assessments, and implementation
  • Making payments according to the agreed-upon terms
  • Obtaining necessary permits and approvals for implementation of designs, unless otherwise agreed upon

5. Payment Terms

Payment terms for our services will be specified in the agreement or contract with each client. Generally, we require:

  • An initial deposit before work begins
  • Payment milestones throughout the project
  • Final payment upon completion of services

All fees and payment schedules will be clearly outlined in the client agreement.

6. Cancellation and Refunds

Our cancellation and refund policy is as follows:

  • Initial deposits are non-refundable as they secure our time and resources
  • Cancellation fees may apply depending on the stage of the project and work already completed
  • Specific cancellation terms will be outlined in the client agreement

7. Limitation of Liability

Tharkhap is not liable for:

  • Damage or loss resulting from the implementation of our designs by third-party contractors or suppliers
  • Delays caused by factors beyond our control, including but not limited to, shipping delays, contractor availability, or natural disasters
  • Indirect, consequential, or incidental damages arising from the use of our services

Our liability is limited to the amount paid for our services.

8. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Massachusetts, without regard to its conflict of law provisions.
